Can Security Guards Detain You in Washington State?
Detainment authority, the shopkeeper's privilege, and the practical policy a disciplined security Team should follow.
The Short Answer
A private security Officer in Washington is a private citizen with a uniform and a license — not a peace officer. There is no statute granting private security independent arrest powers. What exists instead is a narrow set of privileges every professional Officer should be able to recite.
Shopkeeper's Privilege — RCW 4.24.220
Washington gives a merchant, or an agent acting for them, protection from civil liability for detaining a person when there are reasonable grounds to believe merchandise was unlawfully taken, so long as the detention is for a reasonable time and conducted in a reasonable manner. Each of those three words is where cases are won or lost.
- Reasonable grounds means observed conduct, not a hunch or an appearance.
- Reasonable time means as long as it takes to summon law enforcement — nothing more.
- Reasonable manner means no locked rooms, no searches of a person, no force beyond safety.
Citizen's Arrest and RCW 10.31.100
Washington recognizes a limited citizen's arrest for a felony, or a misdemeanor amounting to a breach of the peace committed in the arresting party's presence. RCW 10.31.100 governs what a peace officer may do without a warrant, and understanding that boundary is exactly why our Officers train on it. Guess wrong and the incident becomes unlawful imprisonment, assault, or a civil claim against the property owner who hired you.

Our Officers are trained on the Task Priority Continuum: life safety first, then property, then documentation. The default response to a theft or trespass is presence, verbal direction, and a detailed report with time stamps, descriptions, and photographs — the material that actually supports a prosecution or an insurance claim. Hands go on a person only in defense of a life. That policy is not timidity; it is what keeps Clients out of litigation and Officers out of court.
Trespass Is the Real Tool
For most retail and residential Clients, a documented trespass admonishment is more effective than a confrontation. Once a person has been lawfully warned, a return visit becomes criminal trespass and law enforcement has a clean charge. What Property Owners Should Ask For

- A private security Officer has no police powers. Limited detainment may be lawful under the shopkeeper's privilege (RCW 4.24.220) when a merchant or their agent has reasonable grounds to believe goods were taken, and only for a reasonable time in a reasonable manner.
- Can a security guard touch you or handcuff you in Washington?
- Physical contact by private security is limited to what a private citizen may lawfully do — generally self-defense, defense of others, or a lawful citizen's arrest for a crime committed in their presence. Handcuffing carries real legal exposure and is not part of our standard practice.
- Do you have to show ID to a security guard in Washington?
- On private property, an Officer may ask for identification as a condition of entry or continued presence. You are generally not legally required to produce it, but the property owner may lawfully ask you to leave.
